Determining Liability For Payment Of The Bill

When you do not know if you should pay a bill, you should again ask your insurance company for a clarification. The best way to do this is in writing. We have provided a sample letter to give you an idea of what to include. Once again, you will be doing all you can do to determine who should pay this bill.

What happens when you read your insurance policy and it seems clear to you that you do not have to pay a particular bill, yet the insurance company is refusing to pay it?

Needless to say, this is the area where we must examine a number of factors to determine whether you must pay for services for which you are being billed. Many of these issues of bills in everyday life can be resolved by examining certain contract law issues. However, there are certain preliminary steps you may wish to take first. You should realize that you must battle with your insurance company to make them document why they are not paying this bill and why it is not covered under your policy. Write a letter to them disagreeing with their determination that a bill is not covered, and state, in this writing, your reasons why you believe this bill is covered under your policy. Make them document their response, again, in writing. Do not take an oral explanation by a claims representative over the telephone as your answer. Once the response is received and if they are still denying your claim, or a portion of your claim, you should consider consulting with an attorney and possibly filing a small claims lawsuit against the insurance company.
